If you are considering a divorce in Louisiana, a Baton Rouge Divorce Lawyer can help you sort through the division of assets such as the family home, jointly owned businesses, and retirement or savings benefits.
Uncontested Divorce Requirements
In Louisiana, a married couple does not need to claim grounds for divorce. A couple without children must simply have lived apart or separately for 180 days before a final Judgment of Divorce can be granted. If the couple has children, they must have lived separately for at least one year.
If you and your spouse are filing under faulted grounds, the reasons for separation can include but are not limited to:
- Adultery
- Felony conviction
- Physical or sexual abuse of spouse or children
Asset Division
In an "uncontested divorce," assets can be divided by preparing and executing a "Community Property Partition." This document is generally drawn up by one of the couples' attorney(s) and it is reviewed and revised by both as necessary to finish with a final draft.
Even if your divorce is considered "uncontested," you and your spouse should still seek the counsel of a reputable divorce attorney. The process of divorce can be cumbersome due to complicated laws and regulations of the State. We invite you to contact one of our experienced attorneys at The Layfield Law Firm, LLC for a divorce evaluation.
